1. Introduction
These Terms and Conditions ("Terms") govern access to and use of the Port Harcourt Car Rentals website, rental-request services, vehicle-rental services and related services provided by Port Harcourt Car Rentals ("Company", "we", "us" or "our").
By submitting a rental request, making a Booking, renting a Vehicle, registering as a Partner, Driver, Logistics Officer or Marketer, or otherwise using our services, you ("User", "Client", "you" or "your") acknowledge that you have read and agreed to these Terms.
These Terms apply together with any applicable quotation, Booking confirmation, rental agreement, inspection report, invoice, payment arrangement, or other written terms issued to you for a particular transaction.
Where a transaction-specific written agreement contains a specific term that differs from these general Terms, the transaction-specific term will apply to that transaction.

3. Eligibility and Verification
3.1. Clients must generally be at least 21 years old to rent or drive a Vehicle unless the Company expressly agrees otherwise in writing.
3.2. A Client requesting self-drive must provide a valid driver's licence recognised in Nigeria and any other documentation reasonably requested.
3.3. The Company may require identification and verification documents before approving a rental.
3.4. Information supplied by a Client must be accurate, complete and current.
3.5. The Company may verify information supplied by a Client directly or through appropriate verification processes.
3.6. Providing false, altered, misleading or fraudulent documents or information may result in cancellation of the request or Booking and may result in the loss of amounts paid, subject to applicable law.
3.7. The Company may decline a rental request where verification, vehicle, payment, safety or other reasonable rental requirements have not been satisfied.
4. Client Rental Requests and Bookings
4.1. Rental Request Is Not a Booking
Submitting a rental request, completing an online form, sending a WhatsApp message, making an enquiry or receiving a quotation does not automatically create a Booking.
A Booking becomes confirmed only when:
- Vehicle availability has been confirmed;
- Applicable requirements have been satisfied;
- The agreed price and rental conditions have been accepted;
- Required payment or deposit has been received; and
- The Company has issued confirmation.
4.2. Availability
Vehicle availability is not guaranteed until expressly confirmed. A Vehicle displayed on the website or discussed with a Client may become unavailable before confirmation.
4.3. Vehicle Substitution
Where a confirmed Vehicle becomes unavailable because of mechanical problems, accident, prior commitment, safety concerns or circumstances outside the Company's reasonable control, the Company may offer a comparable alternative where reasonably possible.
If an appropriate alternative cannot be provided, the Company may cancel the affected Booking and deal with amounts paid in accordance with the applicable cancellation/refund arrangement.
5. Prices, Payment and Deposits
5.1. Rental prices are quoted in Nigerian Naira (₦) unless otherwise stated.
5.2. The price applicable to a Booking will be the price communicated and agreed for that Booking.
Additional charges may apply where applicable, including:
- Additional rental time;
- Agreed mileage or excess mileage;
- Fuel or refuelling;
- Tolls;
- Parking;
- Traffic fines and penalties;
- Damage or loss;
- Recovery or towing;
- Cleaning beyond normal use;
- Lost keys or vehicle accessories;
- Unauthorised travel; and
- Other charges expressly communicated to the Client.
5.3. The Company may require a booking fee, advance payment or full payment before handover.
5.4. The Company may require a refundable caution/security deposit before handover.
5.5. The security deposit does not limit the Client's liability where the actual loss, damage, fine or other charge exceeds the amount of the deposit.
5.6. Where a liability cannot reasonably be determined immediately after return, the Company may retain an appropriate portion of the deposit until the relevant matter has been investigated or the amount established.
5.7. Any undisputed balance of the security deposit will be returned within the timeframe communicated to the Client, subject to applicable payment-processing requirements.
6. Cancellation, No-Shows and Refunds
6.1. Cancellation terms applicable to a particular Booking will be communicated at the time of booking where applicable.
6.2. Unless a different written cancellation policy has been agreed:
- Cancellations made 48 hours or more before the scheduled handover may qualify for a refund, less booking fee and any expressly stated non-refundable charges.
- Cancellations made between 24 and 48 hours before handover may be subject to a cancellation charge.
- Cancellations made less than 24 hours before handover may result in forfeiture of the applicable booking fee or deposit.
- Failure to appear for an agreed handover without reasonable prior notice may be treated as a no-show and may result in forfeiture of the applicable booking fee or deposit.
6.3. Where a refund is approved, it will normally be processed within 5–10 Business Days, subject to the payment method and financial institution involved.
6.4. Where cancellation is caused by the Company, Partner or circumstances attributable to the Company, the Company will communicate the available options to the Client in accordance with the applicable Booking arrangement.
7. Vehicle Handover and Inspection
7.1. The Vehicle may be inspected before handover and after return.
The inspection may record:
- Existing body damage;
- Interior condition;
- Tyres;
- Windscreen and glass;
- Mileage;
- Fuel level;
- Accessories;
- Keys; and
- General mechanical or operational observations.
7.2. Photographs, videos, inspection forms, digital records and other reasonable evidence may be used to document the Vehicle's condition.
7.3. Clients should review the Vehicle at handover and report any apparent pre-existing damage or discrepancy before taking possession.
7.4. A Client's failure to report an obvious discrepancy before accepting the Vehicle may be considered when determining the condition of the Vehicle at handover, but does not by itself override evidence of pre-existing damage.
7.5. Final inspection may take place immediately after return or, where necessary, after further examination.
8. Vehicle Use
The Client agrees that the Vehicle will:
- Be used only for lawful purposes;
- Not be used for racing or speed competitions;
- Not be used for reckless or dangerous driving;
- Not be sub-rented, leased or handed over to an unauthorised third party;
- Not be used to transport illegal goods or substances;
- Not be used for any purpose prohibited by applicable law or insurance conditions;
- Not be driven outside the agreed geographical area without approval;
- Not be overloaded beyond lawful passenger or load capacity;
- Not be modified or tampered with without permission; and
- Not be used in a manner that exposes the Vehicle to avoidable damage.
9. Authorised Drivers
9.1. Only the Client or another driver expressly approved by the Company may operate a self-drive Vehicle.
9.2. An unauthorised person must not drive the Vehicle.
9.3. The Client is responsible for ensuring that an additional driver meets all applicable licensing and verification requirements.
9.4. Allowing an unauthorised person to drive may constitute a material breach of the rental agreement and may affect applicable insurance coverage and the Client's financial responsibility.
9.5. Where a chauffeur or Company Driver has been provided, the Client must not operate the Vehicle unless expressly authorised.
10. Driver's Licence and Documentation
10.1. The Client must provide a valid driver's licence where self-drive is requested.
10.2. The Company may request additional identification, proof of address, passport, NIN-related documentation or other verification documents where reasonably necessary for the rental process.
10.3. Documents must belong to the person submitting them and must be genuine and valid.
10.4. The Company may refuse handover where required documentation has not been satisfactorily verified.
11. Late Return and Rental Extensions
11.1. The Vehicle must be returned at the agreed date, time and location.
11.2. A Client who requires additional rental time must obtain approval before the agreed return time.
11.3. An extension is not automatically granted merely because the Client continues using the Vehicle.
11.4. Additional time will be charged at the applicable agreed hourly or daily rate.
11.5. Where a Vehicle is returned late without prior approval, additional charges may apply from the scheduled return time.
11.6. Where a delay materially affects another confirmed Booking, the Client may also be responsible for reasonable additional costs arising directly from the delay, subject to applicable law.
12. Fuel, Mileage, Tolls and Parking
12.1. The agreed fuel level at handover and return should be recorded where applicable.
12.2. The Client may be charged for fuel required to restore the Vehicle to the agreed fuel level.
12.3. Where a mileage limit applies, it will be communicated in the Booking or rental agreement.
12.4. Applicable excess-mileage charges will be communicated before or as part of the Booking arrangement.
12.5. The Client is responsible for tolls, parking charges and other road-use charges incurred during the Client's rental unless expressly agreed otherwise.
13. Damage, Loss and Theft
13.1. The Client may be responsible for damage, loss or theft occurring during the Rental Period where the Client, an authorised driver or an unauthorised person permitted by the Client caused or contributed to the loss or damage.
This may include, where applicable:
- Body damage;
- Interior damage;
- Tyre damage;
- Windscreen or glass damage;
- Lost or damaged keys;
- Damaged accessories;
- Mechanical damage caused by misuse;
- Towing or recovery expenses;
- Theft of the Vehicle or its components;
- Cleaning required because of unreasonable use; and
- Other direct costs reasonably resulting from the incident.
13.2. The Client must immediately notify the Company of any accident, damage, theft, loss, warning light, mechanical fault or other significant incident.
13.3. The Client must not conceal damage or attempt unauthorised repairs.
13.4. Where an incident requires police, emergency, insurance or other official involvement, the Client must reasonably cooperate with the applicable process.
13.5. Where damage is discovered after return, the Company may notify the Client and provide reasonable supporting evidence where available.
13.6. Responsibility for a charge may continue after the Vehicle has been returned where the charge relates to the Client's Rental Period.
14. Accidents and Breakdowns
In the event of an accident, breakdown or serious mechanical problem, the Client must, where reasonably possible:
- Prioritise the safety of occupants and other road users;
- Contact emergency services where necessary;
- Notify Port Harcourt Car Rentals as soon as reasonably possible;
- Provide photographs, location and relevant information;
- Cooperate with police, insurers and authorised representatives;
- Avoid admitting legal liability on behalf of the Company; and
- Avoid arranging major repairs without authorisation except where immediate action is reasonably necessary for safety.
The Company may arrange inspection, recovery, towing or other assistance where appropriate. Costs may be charged to the responsible party where applicable.
15. Traffic Offences and Legal Violations
15.1. The Client is responsible for traffic fines, penalties, toll violations, parking penalties and other charges attributable to the Client or an authorised driver during the Rental Period.
15.2. Where the Company receives a fine, notice or demand relating to the Client's use of the Vehicle, the Company may provide relevant Client details to an appropriate authority where legally required or permitted.
15.3. Administrative costs reasonably incurred in dealing with such matters may also be charged where disclosed in the applicable rental arrangement.
16. Interstate and Restricted Travel
16.1. A Client must disclose intended interstate or long-distance travel before the Booking is confirmed.
16.2. Travel outside Port Harcourt or another agreed geographical area requires prior approval where the Vehicle or Booking conditions require it.
16.3. The Client must provide the intended destination where requested.
16.4. Unauthorised interstate travel or travel into restricted areas may constitute a breach of the rental agreement.
16.5. Additional mileage, security, logistics, insurance or other charges may apply where communicated and agreed.
17. Chauffeur-Driven Rentals
17.1. Where a Driver is provided, the Driver is responsible for operating the Vehicle safely and lawfully.
17.2. Clients must treat Drivers respectfully and must not instruct Drivers to violate traffic laws or operate the Vehicle dangerously.
17.3. Clients must not require a Driver to exceed lawful passenger capacity or undertake unsafe activities.
17.4. Driver availability may be subject to scheduling and reasonable operational limitations.
18. Personal Belongings
18.1. Clients are responsible for their personal belongings placed in or transported in the Vehicle.
18.2. Clients should remove all personal belongings before returning the Vehicle.
18.3. The Company, Partner or Driver will not be responsible for loss of personal belongings except to the extent liability cannot lawfully be excluded.
18.4. Items found after return may be retained temporarily for identification and collection arrangements.
19. Changes to a Confirmed Booking
19.1. Requests to change the Vehicle, rental dates, times, location, destination, driver or other material Booking details are subject to availability and approval.
19.2. A change may result in a revised price.
19.3. A Client must not assume that a change has been approved merely because the Client has requested it.
19.4. Changes should be confirmed by the Company through an identifiable written channel such as WhatsApp, email, SMS or another agreed communication method.
20. Partners / Vehicle Owners
20.1. Partners must provide accurate information concerning their Vehicles.
20.2. Partners are responsible for maintaining required vehicle documentation, insurance, roadworthiness and legal compliance applicable to their Vehicles.
20.3. The Company may inspect, reject, suspend or remove a Vehicle where it does not meet applicable Company requirements.
20.4. Partners must disclose known material defects, damage or mechanical issues.
20.5. Partners must not knowingly provide false information about ownership, vehicle condition, documentation or availability.
20.6. Partner-specific commercial arrangements, commissions and payment terms may be contained in a separate Partner agreement.
21. Drivers
21.1. Drivers must hold the appropriate valid licence and meet applicable verification requirements.
21.2. Drivers must operate Vehicles safely and comply with applicable traffic laws.
21.3. Drivers must not permit unauthorised persons to operate Vehicles.
21.4. Drivers must promptly report accidents, damage, mechanical problems, incidents or client misconduct.
21.5. Drivers must not consume alcohol or impairing substances before or during an assignment.
21.6. Additional Driver obligations and payment arrangements may be contained in a separate engagement agreement.

Specific employment or engagement terms may apply separately.

- Provide accurate information about Company services;
- Avoid misleading claims;
- Use approved branding;
- Avoid unauthorised promises concerning pricing or availability;
- Comply with applicable advertising and communication requirements;
- Follow the Company's referral and commission arrangements.
Commission arrangements may be governed by a separate agreement.
24. Anti-Bypass / Non-Circumvention
24.1. Where the Company introduces a Client to a Partner, Vehicle Owner, Driver or other service provider for the purpose of fulfilling a rental or transportation service, the Client agrees not to knowingly bypass the Company in order to avoid Company fees, agreed charges or contractual arrangements.
24.2. A Partner, Driver, Client or other User must not use contact information, pricing information, business information or relationships obtained through the Company to deliberately divert a transaction away from the Company where doing so would circumvent an existing Company arrangement.
24.3. This provision does not prevent parties from communicating for legitimate purposes where the Company has expressly authorised direct communication.
24.4. Any separate non-circumvention agreement or commercial agreement may contain additional provisions.
25. Prohibited Conduct
Users must not:
- Provide false or fraudulent information;

26.3. Personal information will be handled in accordance with the Company's Privacy Policy and applicable Nigerian data-protection requirements.
26.4. Where necessary for a Booking, relevant information may be shared with a Partner, Driver, logistics personnel, payment provider, verification provider, insurer, professional adviser, law-enforcement authority or other service provider, subject to applicable law and the Company's Privacy Policy.
26.5. Users should review the Company's Privacy Policy for information concerning collection, use, storage, retention and rights relating to personal information.
27. Limitation of Liability
27.1. Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable Nigerian law.
27.2. To the fullest extent permitted by law, the Company will not be responsible for indirect or consequential losses arising from use of the website or services.
27.3. The Company may operate as an intermediary connecting Clients with Vehicles, Partners and Drivers. Where a Partner supplies the Vehicle, responsibility for matters legally attributable to that Partner may remain with the Partner.
27.4. The Company does not guarantee that every Vehicle will be available at all times.
27.5. The Company does not exclude responsibility for matters that cannot lawfully be excluded, including liability arising from fraud or death or personal injury caused by proven negligence to the extent applicable law requires.
28. Events Outside Reasonable Control
The Company will not be responsible for delay or inability to perform caused by circumstances reasonably outside its control, including serious accidents, natural disasters, government restrictions, civil disturbances, major infrastructure failures, widespread outages or other events that materially prevent performance.
Where this occurs, the Company will communicate with affected Clients and take reasonable steps to minimise disruption.
29. Dispute Resolution

29.5. Subject to applicable law and any valid arbitration or dispute-resolution agreement, courts of competent jurisdiction in Rivers State may have jurisdiction over disputes.
30. Changes to These Terms
30.1. The Company may update these Terms from time to time.
30.2. The updated version will state its effective or last-updated date.
30.3. Changes will not automatically alter terms already expressly agreed for a completed Booking where doing so would be inconsistent with the applicable agreement.
30.4. The version applicable to a new Booking will be the version in effect when the Booking is confirmed, unless otherwise agreed.
31. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
32. No Waiver
Failure by the Company to immediately enforce a provision of these Terms does not mean that the Company has permanently waived its right to enforce that provision later.
33. Entire Agreement and Booking Documents
These Terms, together with any applicable Booking confirmation, quotation, invoice, rental agreement, inspection report and other written transaction-specific terms, form the basis of the relevant rental arrangement.
Where there is a conflict, the applicable transaction-specific written agreement will govern that particular transaction to the extent of the conflict.
